1. PROMOTION PERIOD:

Playably, Inc. ("Sponsor") is offering the "Gamified Rebate" Promotion ("Promotion") beginning on September 25, 2026, and ending on 11:59 PM ET on November 1, 2026 (the "Promotion Period"). The conditional event is expected to resolve on or before 11:59 PM ET on Thanksgiving Day, November 26, 2026.

2. PROMOTION ELIGIBILITY:

Promotion is open only to legal residents of the United States who are 18 years of age or older as of the date of entry. The following persons are not eligible to participate in the Promotion: Sponsor; Get Maine Lobster; any of Sponsor's or Get Maine Lobster's parents, subsidiaries, affiliates, or advertising and promotion agencies; and any employee, officer, director, representative or agent of any of the foregoing persons and the immediate family members (spouses and siblings, children and parents and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals. Void where prohibited or restricted by law. Sponsor may verify eligibility at any time. Sponsor will make any determinations of eligibility. Sponsor's decision as to eligibility is final.

3. TO PARTICIPATE:

Eligible customers can enter the Promotion in the following ways:

Entry Method 1 - Conditional Rebate Promotion: Purchase any product from Get Maine Lobster on getmainelobster.com using code BLUELOBSTER during the Promotion Period ("Eligible Product"). Customers who purchase an Eligible Product during the promotion period ("Qualifying Purchase") will receive a full refund (excluding shipping and taxes) if a Blue Lobster of Record is caught in the Gulf of Maine and confirmed by credible public reporting from a verified third party on or before 11:59 PM ET on Thanksgiving Day, November 26, 2026 ("Conditional Event").

For purposes of these Promotion terms, a "Blue Lobster of Record" means a single American lobster (Homarus americanus) that (a) exhibits the blue colouration commonly described as a blue lobster, and (b) is larger, by weight, than the largest blue lobster previously documented in the public record. A lobster satisfies clause (b) only if credible public reporting from a verified third party expressly states that the animal is the largest blue lobster on record, or expressly reports a weight together with a statement that no larger blue lobster has been documented. Sponsor will determine, in its sole discretion, whether reporting meets this standard, and Sponsor's determination is final. A blue lobster that is not reported as exceeding the largest previously documented blue lobster does not constitute the Conditional Event, regardless of its size, rarity, or the amount of coverage it receives. Lobsters of any other colouration, including cotton candy, calico, orange, yellow, split, and albino lobsters, do not constitute the Conditional Event under this Promotion.

Code BLUELOBSTER enrolls the order in the Promotion. It does not change the price of the order or apply any discount at checkout.

If the Conditional Event occurs, all customers who made a Qualifying Purchase are entitled to a full refund of the purchase price paid (excluding taxes and shipping) for the Eligible Product purchased during the Promotional Period ("Rebate") by following the Rebate terms in Section 4 below. If the Conditional Event does not occur, no rebates will be awarded. Limit one (1) Rebate per person/per household, for eligible purchases.

All products purchased during the Promotion Period with code BLUELOBSTER are final sale. No refunds will be issued after November 1, 2026. A refund requested on or before November 1, 2026 will forfeit eligibility for a Rebate. Following November 1, 2026, customers will not be entitled to a refund and may only request store credit or an exchange, at Get Maine Lobster's sole discretion. If the Conditional Event occurs, one (1) winner will be randomly selected from all eligible mail-in entries to receive one (1) Get Maine Lobster Gift Card of $100 (see Mail-In Entry Prize Details below). If the Conditional Event does not occur, no mail-in entry drawing will be conducted.

No purchase necessary to enter or win. Mail-in entry postcard and/or envelope must be written by the eligible customer only. Eligible customers are not permitted to use any third-party service to assist with the entry process in any way (as determined by the Sponsor). Each postcard or envelope must be mailed individually. Bulk shipment of mail-in entries will not be accepted. Limit one (1) mail-in entry per person/per household.

Eligible purchases and/or mail-in postcards must be completed, postmarked, and received by Sponsor no later than 11:59 PM ET on November 1, 2026. Any attempt by a person to use multiple identities, fraudulent transactions, cancelled transactions, or any kind of bot or automated mechanisms to gain more mail-in entries or rebates than permitted by these Promotion terms shall result in disqualification in Sponsor's sole discretion. By participating, eligible customers warrant and represent that they agree to be bound by these terms and the final decisions of the Sponsor. Sponsor reserves the right to disqualify customers suspected in participating in the activities defined above, or any kind of tampering with the Promotion process. Entry information becomes the exclusive property of Sponsor upon submission. Proof of submission of entry does not constitute proof of receipt of entry. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her telephone number during the Promotion.

4. REBATE TERMS:

If the Conditional Event occurs, Sponsor will send an email to the address associated with the Qualifying Purchase containing a link to a Typeform to collect the information necessary to process the rebate, including the customer's Venmo or PayPal account name and number. To claim the rebate, customers must complete and submit the Typeform within forty-five (45) days of the email delivery date.

Customers are solely responsible for completing all required forms accurately and providing all information and documentation requested by Sponsor, which may include proof of purchase, proof of identity, age verification, and/or proof of legal residence. Failure to timely or fully submit the required information or documentation will result in forfeiture of the rebate. Customers are solely responsible for any and all taxes arising from or related to the rebate and may be required to complete, electronically sign, and submit an IRS Form W-9 or other tax documentation as required by law. Where permitted by law, customers who receive a Rebate grants Sponsor the right to use winner's name, city/state, likeness, and prize information for advertising and publicity purposes without additional compensation.

Sponsor is not responsible for any errors, omissions, or delays in communication or transmission, including but not limited to incorrect or incomplete email addresses, spam filters, network issues, or other delivery problems beyond Sponsor's reasonable control. Rebate payments will be processed within thirty (30) business days following Sponsor's receipt and verification of all required materials and paid to the customer's Venmo or PayPal account. The Rebate equals 100% of the product subtotal of the Qualifying Purchase, excluding taxes and shipping.

Sponsor may disqualify any customer from the Conditional Rebate program in its sole discretion if: (a) they fail to provide any required information or documents within the required time period; (b) they fail to comply with any of these Promotion terms.

5. RANDOM DRAWING/ODDS FOR MAIL-IN ENTRIES:

Within seven (7) days of the Conditional Event, Sponsor will select one (1) mail-in entry winner by way of a random number generator from among all eligible entries received. Odds of winning mail-in prize depend on number of eligible entries received and occurrence of Conditional Event.

6. MAIL-IN ENTRY PRIZE:

If the Conditional Event occurs, one (1) mail-in winner will receive a Get Maine Lobster Gift Card valued in an amount of $100 (collectively, the "Prize"). The Prize will be procured, administered, and distributed by Sponsor in the following manner: If the Conditional Event occurs, Gift card will be provided via email and usable only at Get Maine Lobster. Gift card terms apply; not redeemable for cash except as required by law. The total minimum retail value of each Prize is $100 USD. The total minimum retail value of all Prizes is $100 USD. The winner will not receive cash value or any other form of compensation. No prize transfer. No other prize substitution, except at Sponsor sole discretion due to unavailability, in which case a prize of comparable or greater value will be awarded. All taxes (including without limitation Federal, state and local taxes) in connection with the Prize, and the reporting consequence thereof, are the sole responsibility of the winner. Prize winner may be required to sign and return an IRS W-9 form within the time period specified by Sponsor, and such winner will receive an IRS Form 1099 issued in his/her name for the actual value of prizes received if required by law. Sponsor has not made nor is in any manner responsible for any warranty, representation, or guarantee relative to the Prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. Sponsor is not responsible for any and all activities in connection with participation in the mail-in entry methods and/or acceptance and fulfillment of the prize, including but not limited to, any medical illness, personal injury, misuse injury, losses, exposure to COVID-19, or damages in connection with the Prize or potential winner's usage of the Prize following delivery.

7. WINNER NOTIFICATION/VERIFICATION/ADDITIONAL PRIZE RESTRICTIONS:

The potential mail-in entry winner will be notified by email within ten (10) days of the Conditional Event, to verify his/her eligibility and ability to accept the Prize. If such a potential winner is not available or if there is no answer at the time any email is sent, a phone call will be made and a voice message will be left, if possible. Any such email, phone call, or voice message will instruct the potential winner to call a specified telephone number or reply by email within seven (7) days (measured in the local time zone) after the time that the notification message was left. Potential winner may be required to complete, electronically sign, and submit an Affidavit of Eligibility and IRS form W9 (if required by law) within seven (7) days of the date notice or attempted notice is sent, in order to claim his/her prize. Potential winner may also be required to reply as instructed to identify him/herself, confirm his/her eligibility and ability to accept the Prize, and provide his/her complete contact information within such time period, or he/she will be disqualified. In Sponsor's sole discretion, a potential winner may only be notified one time as set forth above for attempted prize notification. If the potential winner does not respond within the seven (7) day time period, Sponsor reserves the right to award the Prize to another potential winner by way of another random drawing. The winner agrees that by accepting the prize, the sponsor reserves the right to use the winner's likeness for marketing purposes without further compensation. Proof of identity, age, and legal residence may be required to claim the Prize. Any winner or potential winner may be disqualified in Sponsor's sole discretion if: (a) he/she fails to provide any required information or properly completed documents within the required time period; (b) he/she fails to comply with any of the terms of these Official Rules; or (c) if any Prize or prize notification is returned as undeliverable, any voicemail or email message is not timely returned, or any forms sent to potential winner are not timely returned as instructed. 8. WARRANTIES AND REPRESENTATIONS:

By participating, eligible customers and mail-in entrants warrant and represent that they agree to be bound by these Promotion terms and the final decisions of the Sponsor. Eligible customers further grant Sponsor and its affiliates and sublicensees the right to use the name, city/state, likeness, and prize information for advertising and publicity purposes without additional compensation.

9. GENERAL CONDITIONS:

Sponsor, Brand Partner, Facebook, Instagram, TikTok, YouTube, Get Maine Lobster, their parents, subsidiaries, affiliates, advertising and promotion agencies, or any wholesalers, retailers, importers, or distributors together with the employees, officers, directors, and agents of each (aforementioned individuals and organizations collectively, the "Releasees") are not responsible and shall not be liable for: [a] failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems or other communications malfunctions; cellular equipment towers, telephone systems or wireless services; [b] interrupted or unavailable network, server or other connections including those through and/or by the Promotion Page; [c] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [d] failed, garbled, lost, misrouted or scrambled transmissions; [e] any error, omission, interruption, defect or delay in any transmission or communication or other errors or problems of any kind whether mechanical, human, technical, electronic, cellular telephone related or otherwise; [f] traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to customer's or any other person's computer or wireless phone/handset related to or resulting from participation in this Promotion; [g] late, lost, incomplete, damaged, or misdirected entries, email messages, or postage-due mail; [h] any condition caused by events beyond the control of the Sponsor that may cause the Promotion to be disrupted or corrupted; or [i] printing errors in Promotion / advertising materials. 10. GOVERNING LAW:

All issues and questions concerning the construction, validity, interpretation and enforceability of these Promotion terms, customer's rights and obligations, or the rights and obligations of Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Under no circumstances will customer be permitted to obtain awards for, and waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and customer further waives all rights to have damages multiplied or increased.

11. PRIVACY:

12. SEVERABILITY/HEADINGS:

If any provision of these Promotion terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Promotion terms and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Promotion terms solely for convenience of reference and shall not be deemed to affect in any manner the meaning or intent of these Promotion terms or any provision hereof.
